Terms of Service

Effective September 17, 2026. Spotify notice updated November 4, 2026.

These Terms are between you and Menu by me n u, Inc., a Delaware corporation (“Menu,” “we,” or “us”), and govern our website, waitlist, mobile app, matching, messaging, restaurant discovery and related services (the “Service”). By creating an account, joining the waitlist or using the Service, you agree to these Terms. Our Privacy Policy explains how we handle information.

1. Who may use Menu

You must be at least 18, legally able to enter a contract and permitted to use dating services where you live. You may not use Menu after removal for a serious safety violation unless we give written permission. Features may differ by location, account eligibility, restaurant, provider and version of the Service.

2. Your account

Provide accurate, current information and maintain one account for yourself. Keep credentials and verification codes private. You are responsible for activity under your account and must promptly report unauthorized access. Do not impersonate anyone, misstate your age or create an account for another person.

3. Dating and dining safety

There is no substitute for acting with caution when communicating with any stranger who wants to meet you. Read our Dating Safety Notice before messaging or meeting anyone.

Menu does not guarantee a person’s identity, intentions, conduct, compatibility or safety. Unless we expressly state otherwise, we do not conduct comprehensive criminal background checks. A photo-verification label or activity indicator does not establish identity, trustworthiness or availability to respond.

Dietary preferences, allergy information and restaurant recommendations are planning aids. They do not establish that a restaurant or dish is safe for you. Discuss allergies, ingredients and cross-contact directly with the restaurant. Menu does not guarantee that profile dietary information has been communicated to or accepted by a restaurant.

4. Waitlist, applications and referrals

Joining a waitlist does not guarantee admission, a launch date or a particular position. We may review applications, change ordering, remove duplicate or fraudulent entries, and change or end referral programs. Where a paid waitlist-skip option is offered, its price and access benefit are shown before purchase and apply to the account associated with the verified transaction. It does not guarantee matches, dates or reservations, or exempt an account from safety requirements.

5. Profiles, messages and content

You keep ownership of content you submit. You grant Menu a worldwide, non-exclusive, royalty-free license to host, copy, display, adapt and distribute that content only as needed to operate, improve and secure the Service, subject to your privacy settings and our Privacy Policy. Using your identifiable photos, messages or profile in external promotional material requires separate permission. The service license ends when the content is deleted, except for reasonable backup, legal and safety-retention periods.

You must have the right to share your content. Do not share another person’s private information or intimate imagery without permission, infringe others’ rights, or post content prohibited by our Community Guidelines. The Privacy Policy, relevant notices and applicable law govern processing of personal information; this content license does not provide blanket consent to sell it.

Spotify content: profile music selections identify content supplied by Spotify and its rights holders. Choosing a song does not transfer ownership of its recording or artwork. Spotify playback and external links are subject to Spotify’s applicable terms and availability; Menu does not promise full-track playback or access to your Spotify library. Our Content & providers notice and Privacy Policy explain catalog searches, artwork requests, the embedded player and your choices. Those notices do not grant permission to download, redistribute or use third-party music or artwork in advertising.

Menu is responsible for its own service. Spotify is not responsible for Menu, and Menu makes no promises on Spotify’s behalf. To the extent applicable law permits, Spotify’s platform, service and content are provided without implied assurances of merchantability, suitability for a particular purpose or non-infringement. You may not modify Spotify’s platform, service or content or create works derived from them, nor decompile, disassemble, reverse-engineer or attempt to obtain their source code or another human-readable form, except where the law permits. Spotify may directly enforce these Terms as an intended third-party beneficiary of these Terms and our Privacy Policy. These provisions do not limit rights that applicable law does not allow us to exclude.

6. Matching, introductions and activity

Menu may recommend people or restaurants using preferences, interests, availability and activity. These recommendations and recent-activity indicators are estimates, not guarantees of compatibility, current presence or willingness to meet. A like, match, direct introduction, proposal or plan confirmation does not oblige another person to respond, attend or continue communicating.

A paid direct introduction, where offered, provides the send benefit described at purchase. It does not guarantee that the recipient will read, accept or answer it. Respect passes, unmatches, blocks and requests to stop. We may use automated and human review to detect fraud, abuse and policy violations.

If you connect a calendar, you authorize the calendar operations described in the feature. Keep availability accurate and review your plans. A calendar entry or its removal is not a restaurant booking, modification or cancellation.

7. Restaurants and OpenTable reservations

OpenTable is Menu’s preferred reservation integration provider. Menu operates independently and does not act as OpenTable’s agent or make guarantees on its behalf. Where enabled, the integration lets you request available reservations at participating restaurants. Other supported services and their applicable terms are identified in the relevant flow.

Availability is a changing snapshot. A suggestion, selected time, temporary hold, mutual plan or booking request is not a confirmed reservation until the restaurant or reservation provider confirms it. Review the restaurant, date, local time, party size, contact details, seating and applicable policies before submitting a booking. You authorize us to send the information and request needed for that action.

Before completing an OpenTable reservation, you must agree to OpenTable’s Terms of Use and Privacy Policy, in addition to applicable restaurant policies. This page does not replace that booking-step agreement.

Changes and cancellations: OpenTable facilitates modifications and cancellations of OpenTable reservations. Use the management instructions in your OpenTable confirmation or contact the restaurant as directed. A message to another Menu member, an unmatch, a removed calendar entry or deletion of your Menu account does not cancel the reservation. A cancellation request is not completed until the responsible provider or restaurant confirms it. If you cannot obtain confirmation before a deadline, contact the restaurant directly.

Charges: restaurants and their providers set any deposits, prepayments, cancellation deadlines, late-cancellation fees, no-show charges and refund conditions. The applicable amount or calculation and material conditions must be presented before you commit. The person accepting a booking’s payment terms is responsible under those terms; Menu does not automatically split a fee between dating participants. We do not add a fee for using the OpenTable integration.

Future compensation arrangements: if Menu introduces a permitted arrangement under which it receives a share of a restaurant’s cancellation or no-show fee, we will disclose our financial interest before the affected booking is made. Such an arrangement must comply with the relevant provider and restaurant agreements. This paragraph does not itself impose a fee, increase an accepted fee, authorize a new charge or establish that a revenue-sharing arrangement is currently active. Any separate charge requires clear disclosure and acceptance before commitment.

OpenTable handles reservation confirmations, reminders and dining-related communications for its integration. Menu remains responsible for support for its own Service. Restaurants remain responsible for food, allergens, service, access and the dining experience. Restaurant names, maps and related information may come from OpenTable, Apple MapKit or other identified sources and may change.

8. Purchases and subscriptions

Menu may offer Menu Reserve subscriptions, paid direct introductions, waitlist access or other described digital features. Prices, billing periods, included benefits and material restrictions are shown before purchase. Local previews or advertised examples do not override the actual purchase screen. No purchase guarantees a match, response, date or reservation.

Automatic renewal: if you purchase an auto-renewing subscription, it renews for the period shown at purchase until cancelled under the applicable purchase terms. Apple purchases are billed to your Apple account. Manage or cancel them through Apple’s subscription settings; deleting Menu or your account does not cancel the subscription. A free or discounted trial, if offered, converts to the disclosed paid subscription unless cancelled within the stated period.

Apple handles refunds for Apple-billed purchases under its rules and applicable law. Restaurant deposits, meals and cancellation charges are separate from Menu’s digital purchases and follow the disclosed restaurant or provider terms. Contact Support about delivery of a purchased Menu feature. Nothing here limits statutory cancellation, refund or other non-waivable rights. New York members should also read the Dating Service Consumer Bill of Rights.

New York purchases

The Dating Service Consumer Bill of Rights is part of these purchase terms. You may cancel without a cancellation fee within three business days after receiving your contract. Submit a signed notice from Menu Reserve → Manage subscription → Request a refund, or email a signed and dated notice to meet@reserved.menu, or send it by certified or registered mail to Menu by me n u, Inc., 155 Wooster Street, New York, NY 10012. Payments must be returned within ten business days after receipt of a valid statutory cancellation notice.

For a contract costing more than $25, if Menu provides no social referrals for two successive months, you may cancel and receive the refund required by New York law. Menu waives the cancellation fee for this remedy. A referral is not a promise of a match, response, date or reservation.

You may place a membership hold of up to one year from Menu Reserve → Manage subscription → Pause membership, or request it in writing at meet@reserved.menu. A hold pauses Menu access and preserves unused membership time; it does not pause Apple billing. A longer hold, up to two years, requires mutual agreement. If you permanently move outside Menu's service area, contact us to cancel and request a prorated refund of the unused prepaid membership period. These requests do not require you to delete your account.

Apple controls Apple subscription billing. Turn off renewal in Apple's subscription settings to prevent another charge. Contact Menu directly to exercise your New York rights; an Apple refund decision does not replace or reduce those rights. We will coordinate the applicable billing remedy and account adjustment without requiring duplicate payment.

9. Communications

Menu may send service and security notices through the app or your account contact information. Text messages require the applicable opt-in or authentication request. Message frequency varies; message and data rates may apply. Reply STOP to opt out or HELP for help. SMS consent is optional and not a condition of joining the website waitlist. Change push permissions in device settings. Reservation-provider communications follow that provider’s terms and choices.

10. Prohibited use

Do not harass, threaten, stalk, discriminate, exploit, scam, solicit money, impersonate, scrape, spam, reverse engineer, disrupt or misuse the Service; evade safety controls; share illegal or harmful content; use Menu commercially without permission; or encourage violations. Do not make fraudulent, speculative or duplicate reservations, repeatedly fail to honor confirmed reservations, resell reservations, misrepresent booking authority or misuse restaurant availability.

11. Reports, blocks and enforcement

Report safety or conduct concerns through available in-app tools or Support. We may investigate, restrict visibility, remove content, suspend or terminate accounts, preserve evidence and cooperate with law enforcement when appropriate. We may notify affected members about suspected fraud or banned members as required by law. You may appeal an enforcement decision through Support.

12. Ending your account

You may stop using Menu and request deletion through Delete Account. We may suspend or terminate access for violations, safety risk, fraud, legal requirements or prolonged inactivity. Account deletion does not cancel outstanding restaurant reservations, accepted payment obligations or independently billed subscriptions. Data is handled under our Privacy Policy. Provisions that logically survive termination, including ownership, outstanding payment obligations, disclaimers, liability limits and governing law, remain effective.

13. Intellectual property

Menu’s software, designs, trademarks and original content belong to Menu or its licensors. Restaurant and provider content and trademarks remain their owners’ property. You receive a personal, limited, revocable, non-transferable right to use the Service, not ownership or a right to extract, resell or redistribute provider content.

14. Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available.” We disclaim implied warranties, including merchantability, fitness for a particular purpose and non-infringement. We do not promise uninterrupted operation, particular results, compatibility, another member’s safety, allergy suitability or restaurant availability. Some jurisdictions do not allow certain disclaimers, so these may not fully apply to you.

15. Limitation of liability

To the fullest extent permitted by law, Menu will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or loss of data, goodwill, profits or opportunities. Menu’s aggregate liability relating to the Service will not exceed the greater of the amount you paid Menu in the preceding 12 months or $100. This does not exclude liability that cannot legally be limited.

16. Changes and availability

We may change, pause or discontinue features and update these Terms. If a change materially affects your rights, we will provide reasonable advance notice through the Service or account contact information and identify when it takes effect. Continued use after that effective date means acceptance except where law requires a separate agreement. A terms update does not itself authorize new charges, personal-data sales or materially incompatible use of previously collected information; applicable disclosures, choices and consent still apply.

17. Governing law

New York law governs these Terms without regard to conflict-of-law principles. Nothing removes consumer protections or venue rights that cannot legally be waived.

18. Contact

Contact Menu by me n u, Inc., 155 Wooster Street, New York, NY 10012, at meet@reserved.menu or through Support. For urgent danger, contact 911 or local emergency services first.
